Participant Agreement and Terms & Conditions

This Participant Agreement and Terms & Conditions (“Agreement”) establish a binding agreement between you (“the Client”) and Radley Adventures FZ LLC, operating under the brand name Summit Expeditions, referred to as “we,” “us,” or “our.”

Please read this Agreement carefully and completely.

BOOKING & PRICES

To secure a booking on one of our expeditions, adventures, or tours (“Trip”), follow the booking procedure on our website or contact our customer support team directly. Your booking is confirmed and a contract is formalized upon receipt of a payment for the Trip, which can be either the deposit or full payment.

Prices are confirmed at the time of booking. We reserve the right to adjust prices only in the case of significant changes in supplier costs, taxes, fees, or exchange rates. Surcharges exceeding 20% allow you to cancel with a full refund.

The quoted price encompasses trip planning, organization, and execution only. Summit Expeditions is not responsible for other expenses, including but not limited to travel insurance, international flights, visas, personal equipment, personal expenses, and other exclusions specified in the Trip description.

PAYMENT & FEES

You must pay the outstanding balance at least 30 days before the first day of your Trip (“Trip Start Date”). If Summit Expeditions does not receive full payment of the balance at least 30 days before the Trip Start Date and no prior arrangements have been made with Summit Expeditions, you will be assumed to have cancelled your participation in the Trip and you will forfeit all fees paid by you. At our discretion, Summit Expeditions may reinstate your reservation on the Trip upon notice from you, full payment, and space availability.

Unless specified otherwise in this Agreement, the deposit is nonrefundable and non-transferable.

Payments made by credit card will be subject to a service fee.

Payments made by bank wire must include the addition of all applicable bank wire fees.

CANCELLATION & REFUNDS

The below information is a summary of Summit Expeditions’ full Cancellation Policy.

Cancellation by You

Cancellations must be in writing and sent via email to us by the party leader as soon as possible, with confirmation of receipt by Summit Expeditions. Verbal cancellations will not be accepted. Funds paid, whether deposit or balance payments, cannot be transferred to another person, unless agreed by Summit Expeditions.

Upon Summit Expeditions’ receipt of cancellation, you will be liable for the following cancellation charges:

  • More than 120 days before Trip Start Date: Forfeiture of Deposit
  • Between 120 and 31 before Trip Start Date: Forfeiture of Deposit and 50% of Additional Funds Paid
  • 30 days or less before Trip Start Date: Forfeiture of Deposit and 100% of Additional Funds Paid

Cancellation by Summit Expeditions

Summit Expeditions may, in its sole discretion, cancel the Trip before the Trip Start Date. If the cancellation is not due to a reason beyond its reasonable control, including acts of God, natural disasters, war, civil disturbance, government action, epidemic, or pandemic (“Force Majeure”), Summit Expeditions will notify you and refund any of the fees paid by you, minus any nonrefundable, prepaid expenses paid by Summit Expeditions for the Trip. Such refund is your sole and exclusive remedy and Summit Expeditions’ sole liability, and you agree to release Summit Expeditions from any further liability, including your pre-departure expenses, airfare, visa fees, clothing and equipment purchases, and medical expenses.

Summit Expeditions may, in its sole discretion, cancel the Trip before the Trip Start Date or during the Trip due to Force Majeure. In such cases, Summit Expeditions will notify you, and you will not be entitled to a refund of any fees paid by you. Summit Expeditions will not be liable to you in any way for such cancellation, and you agree to release Summit Expeditions from any and all liability related to such cancellation.

PROGRAM REQUIREMENTS

To ensure safe and successful participation in the Summit Expeditions Program, you must adhere to the following requirements:

  • You must be in good health to participate in the Trip and complete the medical questionnaire honestly to the best of your knowledge. You will be solely responsible for any costs associated with failing to disclose relevant health information. Upon request, provide Summit Expeditions with a certificate from your physician confirming that you meet the physical and psychological requirements for the Trip.
  • Possess the technical skills and requirements necessary for active participation in the Trip.
  • Provide your own personal clothing, equipment, and medications required for the Trip.
  • Acknowledge that you have thoroughly reviewed the Trip description, itinerary, objectives, and requirements and you will contact Summit Expeditions with any questions or concerns.
  • Procure all necessary permits for the use of personal satellite communications equipment during the Trip and inform Summit Expeditions of such equipment use before the Trip Start Date.
  • Possess health insurance to cover the nature of activities and potential injury or illness during the Trip. Provide proof of this insurance coverage to Summit Expeditions when requested.
  • For international Trips, obtain travel insurance covering flight and trip delays, cancellations, interruptions, and lost, stolen, or delayed baggage.
  • Acknowledge that Summit Expeditions’ obligations for the Trip commence on the Trip Start Date and cease at the conclusion of the Trip. You recognize that activities before and after the Trip are your sole responsibility, releasing Summit Expeditions from any liability.
  • Follow the direction of Trip leaders and third-party guides and exercise reasonable care in all activities.
  • Understand and agree that deviation from planned activities, violation of Trip rules, or failure to adhere to local laws and customs is your sole responsibility.
  • Acknowledge that Summit Expeditions may require withdrawal from the Trip, without refund and at your expense, if your participation jeopardizes safety or the well-being of yourself and others.
  • Follow all host country, city, and local laws and customs during the Trip. Acknowledge Summit Expeditions’ zero-tolerance for criminal acts affecting safety and well-being, leading to withdrawal from the Program without refund and at your expense.
  • Acknowledge and agree that additional expenses may be incurred due to the nature of the Trip (e.g., search and rescue, evacuation, medical treatment). Such costs are your financial responsibility, and you agree to reimburse Summit Expeditions for any such expenses.

SUMMIT EXPEDITIONS’ DISCRETION

Summit Expeditions reserves the right to deny your participation in the Trip at its sole discretion.

Summit Expeditions has sole discretion to modify the Trip, including altering the itinerary, objectives, personnel, or transportation, ending the Trip prematurely, or canceling it, without prior notice, refund, or liability to Summit Expeditions. Due to the dynamic nature of the Trip, you acknowledge that changes may occur based on factors such as government action, weather, terrain, currency fluctuations, cost variations, disease, safety concerns, and travel limitations.

Summit Expeditions, at its sole discretion, may remove you from the Trip before the Trip Start Date or during the Trip if it determines that:

  • You are not physically, technically, or psychologically prepared for the Trip
  • The information you provided when booking or any other communication related to the Trip is untrue, incomplete, or inaccurate, or
  • Removal is in your best interest or the best interest of a third party or Summit Expeditions.

Any discretionary actions taken by Summit Expeditions, as outlined in this Agreement, do not entitle you to a refund and do not subject Summit Expeditions to any liability.

ASSUMPTION OF RISKS

You willingly and consciously agree to participate in the Trip offered by Summit Expeditions. You recognize that foreign travel, mountaineering, climbing, remote environments, and outdoor settings involve hazards and unpredictability, and despite Summit Expeditions’ commitment to safety, it is not infallible. You acknowledge the inherent risks and dangers, including:

  • Transportation via plane, helicopter, car, bus, boat, pack animal, and foot through hazardous environments, foreign countries, and remote areas and terrain;
  • Accommodation hazards, encompassing hostels, hotels, private residences, camps, tents, and improvised shelters;
  • Forces of nature, both foreseen and unforeseen, such as inclement weather, temperatures, hazardous animals and plants, steep and treacherous terrain, bodies of water, avalanches, ice fall, and other natural occurrences;
  • Rugged and dangerous terrain, including boulder fields, river crossings, high mountain passes, glaciers, snow and ice, steep slopes, crevasses, and ice bridges;
  • Injuries and illnesses, whether physical or mental, permanent disability, dismemberment, and death, caused by foreseeable or unforeseeable factors, including altitude sickness, hypothermia, stress, anxiety, and fatigue;
  • Difficult or nonexistent means of communication;
  • Difficult or nonexistent evacuation, rescue, or medical treatment;
  • Insufficient or unsafe food and water supply;
  • Effects of consuming alcoholic beverages or using medications, whether prescription, over the counter, herbal, or recreational;
  • Others in or outside your group acting dangerously or in a manner putting you at risk, including falling, triggering avalanches or ice fall, or exposing you, or prolonging your exposure, to dangerous conditions;
  • Your own actions putting you at risk;
  • Equipment loss, unavailability, or failure;
  • Activities and services provided by third-party service providers;
  • The unpredictability of being in a foreign country, remote environments, and outdoor settings, including changes in the political climate, war, acts of terrorism, violence, and coups;
  • Epidemics and pandemics; and
  • Acts or omissions of Summit Expeditions, Team Leaders, or third-party guides.

You acknowledge that the above list represents only a fraction of the possibilities during the Trip, and creating a comprehensive list is impossible. After reviewing these factors and considering your own capabilities and limitations, as well as the remote and foreign location of this Trip, its risks, and the physical and mental demands involved, you conclude that you are physically and emotionally fit and capable of participating. Despite the inherent risks, you agree to take responsibility for your own welfare and accept all associated risks.

RELEASE OF LIABILITY

Summit Expeditions has made every reasonable effort to provide comprehensive information about the Trip, and you’ve had the opportunity to seek clarification by asking any questions.

In consideration of the services provided by Summit Expeditions, you and your legal representatives release, discharge, acquit, and covenant not to sue Summit Expeditions, including its owners, officers, directors, agents, contractors, and employees, from any claims and liability arising from your participation in the Trip. This includes claims for property loss, damage, injury, or death. To clarify, you agree not to pursue legal action against Summit Expeditions, and if you do, you forfeit the right to collect any monetary compensation.

You commit to indemnify and hold harmless Summit Expeditions and all Trip members from any payment obligation resulting from your participation in the Trip. This indemnification extends to your family members, including your spouse, minor children, dependents, and heirs.

You acknowledge and agree that you’ve received complete disclosure and, with full understanding, voluntarily and knowingly consent to assume all risks outlined in this Agreement. Additionally, you release Summit Expeditions from any liability associated with these risks.

You confirm that you have carefully read and fully comprehend the content and legal implications of this Agreement. Recognizing it as a legally binding and enforceable contract, you sign it of your own free will.

GENERAL TERMS & CONDITIONS

For convenience, Summit Expeditions may assist you with flights, lodging, transportation, and other third-party services during the Trip. However, Summit Expeditions is not an employee, employer, agent, or subcontractor of any third-party service provider and will not be responsible for any issues arising from such services.

You consent to Summit Expeditions and its agents taking or using photographs or video recordings of you for commercial and promotional use without compensation.

No guarantees have been made regarding the Trip’s objectives due to its nature.

In emergencies where you are unable to make healthcare decisions, you consent to Summit Expeditions making decisions for your health and safety.

All team or group supplies and equipment are the sole property of Summit Expeditions.

COMPLAINTS

If you have any complaints during the Trip, please promptly notify Summit Expeditions’ trip leaders or local agents. If the issue remains unresolved, contact Summit Expeditions directly, providing comprehensive details and your contact information.

We are committed to addressing and resolving concerns to ensure a positive Program experience.

GLOSSARY

  • Agreement: Refers to the Participant Agreement and Terms & Conditions document establishing a binding agreement between the Client and Summit Expeditions.
  • Client: Refers to the individual or participant entering into the agreement with Summit Expeditions, also referred to as “you” or “the Client.”
  • Summit Expeditions: The trade name under which Radley Adventures FZ LLC operates, referred to as “we,” “us,” or “our” in the agreement.
  • Trip: A tour, adventure, or expedition organized by Summit Expeditions, as outlined in the agreement, also interchangeable with the term “Program.”
  • Trip Start Date: The first day of the Trip, as specified in the agreement.
  • Deposit: An initial payment made by the Client to confirm a booking, typically nonrefundable and non-transferable, unless specified otherwise.
  • Balance: The outstanding amount of the Trip fee, payable at least 30 days before the Trip Start Date.
  • Cancellation: The act of terminating participation in the Trip, subject to specific conditions and charges outlined in the agreement.
  • Force Majeure: Unforeseeable circumstances beyond Summit Expeditions’ control, including acts of God, natural disasters, war, civil disturbance, government action, epidemic, or pandemic.
